A BILL to amend article two-c, chapter forty-eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section sixteen, relating to funding of the family protection services board.

Be it enacted by the Legislature of West Virginia:
That article two-c, chapter forty-eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section sixteen, to read as follows:
ARTICLE 2C. DOMESTIC VIOLENCE ACT.

§48-2C-16. Voluntary check-off designation.

(a) Each West Virginia individual income tax return form shall contain a designation as follows:
Family Protection Services Board
Check ( ) if you wish to designate $1, $5, $10 or more of your tax refund for this program. If joint return, check ( ) ifspouse wishes to designate $1, $5, $10 or more.
(b) Each individual taxpayer desiring to contribute to the family protection services board may designate by placing an "X" in the appropriate box on the state income tax form. His or her contribution shall be credited to said program.
(c) The tax department shall determine by the first day of July of each year the total amount designated pursuant to this legislation and shall report such amount to the state treasurer who shall credit such amount to the family protection services board.
(d) The funds shall be used in accordance with the duties of the family protection services board set forth in section four, article two-c, chapter forty-eight of the code of West Virginia.



NOTE: The purpose of this bill is to provide funding of domestic violence programs through contributions to the family protection services board.
